By accessing  or using this Website, you agree to these Terms.  If you do not agree with these Terms,  you should not use the Website.

  1. About TradeMark Wholesale

TradeMark Wholesale is an Australian-owned wholesale distributor of trade tools, accessories and related products for the plastering, building and construction industries.

Our products are primarily supplied through plasterboard resellers, hardware stores,  trade retailers and other independent distributors throughout Australia  and New Zealand.

The Website is primarily provided as a source of information about TradeMark Wholesale,  our brands, products,  technical information and where our products may be purchased.

  1. Website Information

We take reasonable care to ensure  information published  on the Website is accurate  and current. However, product ranges, specifications, dimensions, materials, packaging, colours,  images,  technical

information and availability  may change from time to time without notice.

Images on the Website are provided for illustrative purposes. Actual products may differ slightly in appearance, packaging, colour, specifications or other characteristics.

We may correct errors  or update, modify or remove Website content at any time.

  1. Product Information

Information provided on this Website about our products is intended as general  product information only. Customers and users must:

  • read and follow all instructions supplied with a product;
  • review applicable product labels, technical data sheets and Safety Data Sheets where relevant;
  • ensure products are suitable for their intended application;
  • comply with applicable workplace health and safety requirements; and
  • where appropriate, obtain advice from a qualified tradesperson, engineer, builder or other relevant professional.

Technical  information on the Website should not be treated as a substitute for professional advice, installation requirements, manufacturer instructions or the requirements of a particular building system.

TradeMark Wholesale is not responsible for product failures  caused by incorrect  storage,  handling, installation, modification, misuse or use contrary  to applicable product instructions, subject always to rights that cannot lawfully be excluded.

  1. Where to Buy

The Website may provide information about retailers or allow you to contact us to locate a retailer  that stocks TradeMark Wholesale products.

Unless expressly stated otherwise, retailers and distributors are independent businesses and are not owned, operated  or controlled  by TradeMark Wholesale.

Product availability, stock levels, pricing, delivery,  payment terms and other retail conditions are determined by the relevant  retailer.

Providing details of a retailer  does not constitute  an endorsement or guarantee regarding that retailer's services, stock or pricing.

  1. Purchases and Wholesale Orders

Unless expressly indicated otherwise, the Website does not itself constitute  an online store and submitting an enquiry through the Website does not create a contract for the purchase or supply of goods.

Purchases made through an independent TradeMark Wholesale retailer  are subject to the terms applicable between you and that retailer.

Wholesale customers who purchase products directly from TradeMark Wholesale may also be subject to separate:

  • trading terms;
  • credit terms;
  • quotations;
  • purchase orders;
  • invoices;
  • distribution arrangements; or
  • other commercial agreements.

Where there is an inconsistency between these Website Terms and separately agreed trading or supply terms,  the separately agreed terms will apply to the relevant  commercial transaction.

  1. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any guarantee, right, remedy or other protection  that cannot lawfully be excluded under the Competition  and Consumer Act 2010 (Cth), including the Australian Consumer Law, or any other applicable legislation.

Where products are supplied to a person who is a “consumer”  for the purposes  of the Australian Consumer Law, that person may have statutory  rights and remedies in addition to any manufacturer's or TradeMark Wholesale warranty.

Any product warranty published  by TradeMark Wholesale is provided in addition to rights and remedies that cannot lawfully be excluded.

  1. Product Warranties

Certain TradeMark Wholesale products may be covered by specific written warranties.

Where a separate warranty applies to a product, the conditions and procedures contained  in that warranty apply in addition to any rights available  under applicable law.

Customers should retain proof of purchase and contact the retailer  or distributor from whom the product was purchased in the first instance, unless the applicable warranty states otherwise.
